A former employee of the Defendant, Dylon Dykstra (“Plaintiff” or “Class Representative”), filed a lawsuit against The Shield Co Management, LLC dba Ecoshield Management Co. (“Defendant”) on behalf of himself and a class of similarly situated employees. The lawsuit,Dykstra v. The Shield Co Management, LLC, Case No. 23-2-24015-4 KNT (the “Lawsuit”) is currently pending in King County Superior Court. Plaintiff claimed in the lawsuit that Defendant failed to provide non-exempt, hourly employees with: (1) compliant drive-time wages and compensation; (2) compliant meal periods; (3) compliant rest periods; (4) all wages due and compensation for missed and noncompliant meal and rest periods; and (5) accurate wage statements. Defendant denies these allegations, and contends that it has always complied with all applicable local, state, and federal laws and requirements.

The Court has not made any determinations regarding the merits of the Plaintiff’s claims and it has not decided whether Defendant has violated the law.

The parties to the lawsuit (the “Parties”) have reached a proposed Class Action Settlement. The settlement includes a total payment by Defendant of $930,000 (“Common Fund”). On January 9, 2025, the Court issued an order preliminarily approving the settlement and authorizing the Settlement Administrator Simpluris, Inc. (“Settlement Administrator”) to issue the Notice.

If you received a Notice it is because Defendant’s records indicate you are eligible to participate in the settlement as a member of the Settlement Class. “Settlement Class Members” include “All persons who, between November 6, 2020 and January 9, 2025 were employed by Defendant in the State of Washington as non-exempt, hourly Pest Control Technicians or similar titles.”

The Court still has to decide whether to approve the settlement. No settlement benefits or payments will be provided unless the Court approves the settlement and it becomes final.

Your Legal Rights and Options

Do Nothing

You will remain in the Settlement Class, receive a settlement payment, and will release certain claims against Defendant.

Exclude Yourself from The Settlement

If you request to be excluded, you will no longer be in the Settlement Class and will not receive a settlement payment. However, you will keep any right to sue Defendant about the same legal claims in this Lawsuit. The deadline to request exclusion from the settlement is March 10, 2025.

Object To the Settlement

Write to the Court explaining why you do not agree with the settlement. You must not exclude yourself from the settlement if you wish to object. The deadline to object is March 10, 2025.

Attend The Final Approval Hearing

You may ask the Court for permission for you or your attorney to speak about your objection at the Final Approval Hearing. The Final Approval Hearing will be held on April 25, 2025, at 10:00 A.M.
